Privacy notice
This notice explains what personal information Livingstone Pharmacy collects, why we collect it, who we share it with, how long we keep it, and the rights you have over it.
Who we are
Livingstone Pharmacy is a trading name of John Ross (Inverness) Limited, which is responsible for the personal information described here (the "data controller"). What information we collect
The main thing this website collects is the switch your prescriptions form, which asks for:
- the patient's name and date of birth;
- contact details — email, phone, address and postcode;
- whether you are filling it in for yourself or for someone else (and if for someone else, your name and relationship to them);
- the patient's current GP practice;
- a signature, or a tick confirming the request is genuine.
Because it tells us you are, or want to become, a patient here, this counts as health information — which the law treats as especially sensitive, and which we handle with extra care.
If you email, call or write to us, we keep what you tell us for as long as it takes to help you.
How we use it
We use the details from the form only to contact your GP practice and arrange the transfer, and then to dispense your prescriptions and look after your care as your pharmacy.
Because we provide NHS services, the law allows us to use your health information to provide your care — we do not depend on you ticking a box for that. The boxes on the form simply give us your permission to approach your GP on your behalf; you can tell us to stop at any time. We also keep the records the law and the NHS require us to keep.
Giving us your details is voluntary, but we cannot arrange a transfer without them — so if you would rather not use the form, you can speak to us instead. We do not make automated decisions about you, and we do not profile you.
How long we keep it
We keep records only as long as we need them. Health and care records are kept in line with the NHS in Scotland's records management rules — for pharmacy patient records the standard is ten years after a patient's death. Your transfer request becomes part of your patient record once you switch. A general enquiry that is not part of your care is kept only until we have dealt with it.
Keeping your information safe
Everything you send through this website is encrypted in transit. Your transfer request is emailed straight to the pharmacy — nothing is stored on the website itself, and the only lasting copy is the email in our own secure mailbox. Only the staff who need to see your information can, and everyone here is bound by patient confidentiality.
If anything ever went wrong with your information in a way that put you at risk, we would report it to the Information Commissioner's Office and tell you.
Your rights
Under data protection law you can ask us to:
- give you a copy of the information we hold about you;
- correct it if it is wrong or incomplete;
- erase it, or stop using it, in certain circumstances;
- explain how we use it — which is what this notice is for.
Some of these do not apply to health records we are required to keep — for example, we usually cannot simply delete a patient record on request. If a right does not apply in your case, we will tell you why.
To ask about any of this, or to change your mind about a transfer, contact us using the details in Who we are. We will reply within one month, and there is normally no charge.
How to complain
If you are unhappy with how we have handled your information, please tell us first — we would like the chance to put it right. You can also give us feedback.
You can also complain to the Information Commissioner's Office, the UK's independent data protection regulator, on 0303 123 1113 or at ico.org.uk/make-a-complaint. Complaining to us first does not affect that right.
